Premature Discharge Your Injury, Our Fight

Premature Discharge Attorney in Albuquerque

When a Patient Is Sent Home Before It Is Medically Safe

A patient can leave a hospital or emergency department and later need additional treatment without medical malpractice having occurred. The legal issue is not simply whether the patient's condition worsened after discharge.

A potential premature discharge claim depends on whether the discharge decision and planning met the applicable standard of care based on the information available at the time and whether a departure from that standard caused additional harm.

At Buckingham & Vega Law Firm, we evaluate the treatment timeline, symptoms, test results, medications, discharge instructions, follow-up plan, and medical care required after the patient left the facility.

Call (505) 388-0066 or contact us online for a free consultation with our Albuquerque legal team if you believe you were discharged before it was safe.

What Can Make a Hospital Discharge Unsafe?

The standard of care depends on the patient's condition and the medical information available when the discharge decision was made.

A review may examine whether the patient had unresolved or worsening symptoms, abnormal findings, pending tests, medication needs, or other clinical concerns that required additional evaluation, monitoring, treatment, or follow-up.

Relevant issues may include:

  • Unresolved symptoms: Whether pain, breathing problems, neurological symptoms, fever, weakness, altered mental status, or other concerns had been sufficiently evaluated before release.
  • Abnormal or pending test results: Whether laboratory studies, imaging, or other findings required further review or treatment before discharge.
  • Clinical stability: Whether vital signs, mobility, mental status, oxygen needs, or other aspects of the patient's condition supported discharge at that time.
  • Medication planning: Whether prescriptions, dosage changes, medication interactions, or access to necessary medication were addressed appropriately.
  • Discharge instructions: Whether the patient received appropriate return precautions and understood when worsening symptoms required emergency care.
  • Follow-up care: Whether medically necessary follow-up, specialist evaluation, home care, or other services were appropriately arranged.

A poor outcome does not establish that any of these duties were breached. The medical record and expert review may be necessary to determine what a reasonably careful provider should have done under the circumstances.

How Premature Discharge Differs From a General Failure to Treat Claim

Premature discharge can overlap with other forms of medical negligence, including misdiagnosis and failure to treat.

The distinction is the focus of the review.

A failure to treat claim may concern care that should have been provided at many stages of a patient's treatment. A premature discharge claim focuses more specifically on whether the patient should have remained under evaluation or treatment and whether the transition out of the facility was handled safely.

The same case can involve more than one issue. For example, a provider may fail to recognize a serious condition and then discharge the patient before that condition is identified.

A Relevant $10 Million Emergency Room Result

Buckingham & Vega Law Firm has handled medically complex cases involving emergency-room decisions and the consequences of sending a patient home without recognizing a serious underlying condition.

In one published case, a patient went to an emergency department with severe calf pain, discoloration, and numbness in her toes. The provider diagnosed lumbar radiculopathy and sent her home. Her condition worsened, and further medical evaluation identified an arterial blockage. The injury ultimately resulted in an above-the-knee amputation.

The firm secured a $10 million settlement in that emergency-room misdiagnosis matter.

That case was not a guarantee of any future result, and the legal issues in another discharge case may be different. It does, however, reflect our experience analyzing the relationship between emergency medical decisions, discharge, subsequent deterioration, and serious injury.

Medical Insight in Reviewing an Early Discharge

Founding partner Kent Buckingham practiced for several years as an eye doctor before beginning his legal career and is Board-Certified in Personal Injury Trial Law by the Texas Board of Legal Specialization.

His prior clinical background informs the firm's review of medical records, symptoms, test results, treatment decisions, and disputed questions of causation.

Since 1999, has handled serious personal injury, medical malpractice, and wrongful death claims. The firm has handled thousands of personal injury matters and has taken on hospitals, health care systems, providers, and insurers in complex negligence cases.

Connecting the Discharge to the Later Injury

A premature discharge claim requires more than showing that a patient returned to the hospital.

Readmission, a new diagnosis, emergency treatment, or a worsening condition may be important evidence, but those facts do not prove malpractice by themselves.

A causation review may consider:

  • How the patient's condition changed after discharge
  • How soon additional care became necessary
  • Whether the patient followed the discharge instructions
  • What later clinicians diagnosed
  • Whether the underlying condition was already present or detectable before release
  • Whether additional observation, testing, treatment, or consultation would likely have changed the outcome

Qualified medical professionals may be needed to explain both the standard of care and whether the discharge decision caused additional harm rather than merely preceding it.

Evidence That May Matter After an Unsafe Discharge

Hospital and emergency-department records can help reconstruct what providers knew before the patient left.

Relevant evidence may include:

  • Emergency department and hospital notes
  • Nursing documentation
  • Vital-sign records
  • Laboratory and imaging results
  • Consultation notes
  • Medication administration records
  • Discharge orders and instructions
  • Prescriptions
  • Patient portal communications
  • Follow-up appointments and telephone calls
  • Ambulance, readmission, or subsequent treatment records

When possible, also preserve the documents provided at discharge and a timeline of symptoms and medical care after leaving the facility.

If your condition is worsening or urgent, seek appropriate medical attention first. Do not delay necessary care to collect evidence or speak with an attorney.
